Terms of Service

1. Acceptance of Terms

By accessing, registering for, or using the TestAngle visual browser testing platform (collectively, the “Service,” “Platform,” or “Application”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations.

If you are entering into this agreement on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you may not access or use our Platform.

2. Workspace Accounts & Security

To utilize the visual test builder, API suites, and cloud runners, you must create a workspace account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the absolute confidentiality of your credentials, password, API keys, and Robot account token profiles.
• Limit workspace seats and Robot account keys strictly to authorized developers, QA engineers, and automated CI/CD runners.
• Promptly notify us at security@testangle.com if you suspect any unauthorized access to your workspace or secret keys.

TestAngle will not be liable for any loss, damage, or security breach arising from your failure to safeguard your credentials or from the exposure of your environment variables and secrets.

3. Subscriptions, Billing, Quotas, and Refund Policy

We provide access to the Platform under various tiers (Free, Starter, Pro, Team, Enterprise) subject to the following billing policies:

• Billing Cycles: Paid tiers are billed in advance on a recurring monthly or annual basis (via Stripe). Subscriptions automatically renew unless cancelled before the renewal date.
• Pricing & Fee Modifications: We reserve the right to revise subscription fees, runner credit rates, and add-on pricing at any time. For active recurring subscriptions, any price adjustments will take effect upon your next billing cycle following at least thirty (30) days prior notice (which may be delivered via email or in-app notice). Your continued subscription after the effective date constitutes your agreement to pay the revised amount.
• Limits & Quota Enforcement: Plans dictate active project counts, parallel execution slots, concurrent interactive sandboxes, API call volumes, worker runtime minutes, and log retention timelines. Exceeding these limits may result in the automatic queueing, throttling, downgrading, or blocking of automated test executions.
• Free Tier Fair-Use, Queue Jitter & Resource Preemption: Workspaces on the Free tier access cloud runner clusters and virtual browser instances on a shared, best-effort availability basis. To ensure system stability and protect paying subscribers, TestAngle reserves the unrestricted right to apply execution queue staggering, intentional dispatch jitter, concurrency limits, rate limiting, and queue back-off to Free tier runs. During periods of peak platform load, high traffic, or infrastructure contention, runner cluster capacity and scheduling priority are strictly reserved for active paying subscribers (Starter, Pro, Team, and Enterprise). Free tier execution jobs may be delayed, queued behind paid workloads, preempted, or temporarily throttled without prior notice.
• Right to Alter Subscription Features & Tiers: We expressly reserve the right, at any time and in our sole discretion, to modify, adjust, add, decrease, or remove any features, tools, execution allowances, quotas, or perks associated with any subscription tier (whether Free, Starter, Pro, Team, or Enterprise) without any requirement to notify current, past, or prospective subscribers. Subscribing to a tier does not guarantee the permanent availability of any specific feature or functionality.
• General No-Refund Policy: Except where strictly mandated by applicable law, all fees, subscription renewals, and prepaid runner credit balances are non-refundable. Voluntary cancellation during an active subscription cycle will not entitle you to any prorated refund.
• Forfeiture of Fees Upon Misconduct or Suspicious Activity: If your account, workspace, or access is throttled, limited, downgraded, suspended, or terminated due to suspected fraud, abusive behavior, malicious scanning, unauthorized testing, breach of our Acceptable Use Policy, or any violation of these Terms, YOU EXPRESSLY FORFEIT ALL PAID FEES, OUTSTANDING SUBSCRIPTION PERIODS, PREPAID CREDITS, AND BALANCES. NO REFUNDS, CREDITS, CHARGEBACK RIGHTS, OR PRORATIONS WILL BE ISSUED UNDER ANY CIRCUMSTANCE FOR TERMINATIONS ARISING FROM ABUSE, FRAUD, OR SUSPICIOUS ACTIVITY.

4. Modifications to the Service, Features, and Terms

We are constantly iterating and improving the Service. As such, we reserve the unrestricted right, at our sole discretion and at any time, without prior notice or liability to you or any third party, to:

• Add, modify, alter, suspend, deprecate, or permanently discontinue any aspect, feature, API, integration, runner capability, quota, or tool across the Platform or within any specific subscription tier.
• Reallocate features between free and paid tiers, introduce feature gates, or impose new usage thresholds, limits, or fees on previously unrestricted or free capabilities.
• Update, revise, or replace these Terms of Service. Changes become effective immediately upon posting.

Your continued use of or access to the Platform following any modifications to the features, subscription tiers, or these Terms constitutes your unconditional acceptance of such changes. TestAngle shall not be liable to you or any third party should we exercise our right to modify, change, suspend, or discontinue any feature, tier, or portion of the Service.

5. Acceptable Use Policy & Automated Target Abuse

Our Cloud Runners provision browser instances (Chrome, Firefox, Safari) and network proxy infrastructure to interact with web targets. To protect target servers, our infrastructure, and third-party networks, you agree NEVER to use our Platform, runners, or APIs to:

• Execute automated visual, API, or code tests against websites, systems, networks, or domains that you do not own, or for which you lack explicit, verifiable written authorization from the owner.
• Deploy Denial of Service (DoS) or Distributed Denial of Service (DDoS) simulations, stress testing, vulnerability probes, brute-force attacks, or traffic spikes designed to exhaust target bandwidth, compute, or database capacity.
• Scrape content, harvest user credentials, bypass access controls, or collect public or private data from competitors or unauthorized third-party targets.
• Automate CAPTCHA-solving tools, distribute spam, forge headers, submit fraudulent transactions or web forms, engage in click-fraud, or circumvent paywalls.
• Distribute malware, launch phishing or credential-stuffing campaigns, conduct command-and-control operations, establish unauthorized VPN/tunneling bridges, or execute cryptocurrency miners on cloud worker instances.
• Engage in any activity that violates applicable local, state, national, or international laws, export regulations, or sanctions (including OFAC).

Violation of this Acceptable Use Policy constitutes a material breach of these Terms and will result in immediate workspace termination, forfeiture of all funds, permanent blacklisting, and reporting to competent law enforcement and regulatory authorities.

6. User Assets & Intellectual Property

• Your Content: You retain complete ownership of all visual test configurations, step assets, custom headers, trace histories, video recordings, and screenshots generated by your workspace (“User Content”). You grant TestAngle a limited, non-exclusive license to store, process, and execute this content solely to deliver testing services to your team.
• Our Platform: TestAngle owns all rights, titles, and interests in the Platform, visual builder layout, brand trademarks, source code, server runner orchestration, and error translation engines. You may not copy, reverse engineer, or redistribute our proprietary software.

7. Disclaimer of Warranties (“AS IS” & “AS AVAILABLE”)

THE PLATFORM, CLOUD RUNNERS, API SUITES, TEST BUILDERS, AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To the maximum extent permitted by applicable law, TestAngle disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant that:

• The Platform or cloud browser runners will operate uninterrupted, secure, error-free, or meet your specific QA or testing schedules;
• Test runs, visual diffs, step assertions, or automated recordings will be entirely free from latency, runner delays, flakiness, or dropped frames;
• Target third-party websites or services will render accurately or accept automated browser connections; or
• Any defects, bugs, or runner errors will be corrected within any specific timeframe.

8. Limitation of Liability, Financial Cap & Indemnification

You understand that automated browser testing triggers actual state changes and requests on target environments (including clicking checkout buttons, submitting forms, triggering webhooks, modifying databases, or altering server state).

TESTANGLE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUBPROCESSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES WHATSOEVER ARISING FROM OR RELATING TO YOUR USE OF THE PLATFORM OR CLOUD RUNNERS. THIS INCLUDES, WITHOUT LIMITATION, TARGET SYSTEM OUTAGES, SERVICE CRASHES, ACCIDENTAL TRANSACTION CHARGES, LOSS OF DATA OR PROFITS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR ACCIDENTAL DISCLOSURE OF SECRETS OR CREDENTIALS STORED IN TEST SUITES.

Aggregate Financial Cap: In no event shall the total aggregate liability of TestAngle, whether in contract, tort (including negligence), strict liability, or any other legal or equitable theory, exceed the total amounts actually paid by you to TestAngle in the three (3) months immediately preceding the event giving rise to liability, or one hundred U.S. dollars ($100.00 USD), whichever is greater.

Indemnification:You agree to defend, indemnify, and hold harmless TestAngle and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, expenses, penalties, fines, and legal fees (including reasonable attorneys’ fees) arising out of or related to:

• Your access to or use (or misuse) of the Platform, cloud runners, proxies, or API endpoints.
• Any test actions, scripts, traffic, or automated queries directed against target systems, domains, or infrastructure (whether owned by you or third parties).
• Any violation of these Terms, our Acceptable Use Policy, or applicable laws, regulations, or third-party rights (including privacy, intellectual property, or computer crime statutes such as the CFAA).
• Any dispute or claim between you and any third party whose systems or users were impacted by tests executed through your account.

9. Right to Suspend, Downgrade, Limit Quota, and Terminate

We reserve the absolute right, in our sole discretion and without prior notice or liability to you, to immediately:

• Investigate & Monitor: Monitor execution logs, outbound network patterns, and resource consumption where we detect abnormal traffic, excessive concurrency, or suspected abuse.
• Limit, Throttle, or Downgrade: Restrict parallel execution slots, reduce worker runtime caps, throttle API rate limits, or downgrade workspace subscription tiers if we suspect abusive, non-standard, or resource-draining behavior.
• Suspend or Terminate Access: Temporarily suspend or permanently terminate your workspace, user accounts, API keys, and access to all Platform features if:
  • We detect or reasonably suspect any fraudulent, unlawful, abusive, or unauthorized activity;
  • You violate our Acceptable Use Policy or any provision of these Terms;
  • Your test operations pose a security, legal, regulatory, or operational risk to TestAngle, our hosting infrastructure, or third-party targets;
  • We receive abuse reports, takedown notices, or inquiries from hosting providers, law enforcement, or affected target domain owners; or
  • You fail to resolve outstanding invoices or billing disputes.
• Cooperation with Law Enforcement: We reserve the right to report unlawful activities to law enforcement and regulatory bodies, preserve evidence, and disclose account information and audit logs pursuant to lawful subpoenas, warrants, or court orders.

Upon termination, your right to access the Platform will immediately cease, all running jobs will be halted, and your stored test configurations, recordings, and secrets will be permanently purged without compensation.

10. Governing Law, Binding Individual Arbitration & Class Action Waiver

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Binding Individual Arbitration:Except for claims seeking emergency injunctive or equitable relief regarding intellectual property rights or unauthorized access to our infrastructure, any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or the Service shall be settled by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules.

CLASS ACTION WAIVER: YOU AND TESTANGLE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. NO ARBITRATION OR COURT PROCEEDING SHALL BE JOINED WITH ANY OTHER OR DECIDED ON A CLASS-WIDE BASIS.
